Terms of Service

1. Acceptance

By downloading, installing, or using KastDrive ("the Software"), you agree to these Terms of Service ("Terms") with Vohux Inc. ("we", "us", "our"). If you do not agree, do not use the Software.

2. Licence grant

Subject to these Terms, we grant you a non-exclusive, non-transferable licence to install and use KastDrive on up to two (2) personal Macs you own or control. Commercial use within a single organisation is permitted under the same licence.

The Free tier licence is perpetual. Pro Lifetime includes the Software plus one (1) year of updates from the purchase date. Pro Annual licences are valid for the subscription term; access reverts to the Free tier if not renewed.

3. Restrictions

You may not:

• Reverse-engineer, decompile, or disassemble the Software;
• Redistribute, sublicence, rent, or resell the Software;
• Remove or obscure copyright notices;
• Use the Software to build a competing product;
• Circumvent licence validation mechanisms.

4. Updates and version support

Pro Lifetime purchasers receive updates for twelve (12) months from purchase. Future major versions (e.g. KastDrive 2.0) may be offered at a discounted upgrade price but are not included. Pro Annual subscribers receive all updates while their subscription is active. Free tier users receive the version available at download only.

5. Payments and refunds

Payments are processed by LemonSqueezy as our Merchant of Record. All prices are in USD. LemonSqueezy calculates and remits applicable VAT, GST, and sales taxes. We offer a 30-day money-back guarantee — see our Refund Policy for details.

6. Privacy

Use of the Software is subject to our Privacy Policy, incorporated by reference into these Terms.

7. Disclaimer of warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Software will be error-free or uninterrupted.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOHUX INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits liability for fraud, gross negligence, or death or personal injury caused by our negligence, to the extent not permitted by law.

9. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Ontario.

10. Changes to these Terms

We may update these Terms. Material changes will be notified via in-app notice at least 30 days in advance. Continued use after the effective date constitutes acceptance.
